By accessing or using 3ybe.com, its mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not access or use the Service.
1. Eligibility
You must be at least 18 years old to use the Service.
You must provide accurate, current, and complete information during registration.
You may not use the Service if your account has been previously suspended or terminated.
Minors under 18 are prohibited from using the Service, with or without parental consent.
You represent that you have the legal capacity to enter into these Terms.
2. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials.
Notify us immediately at support@3ybe.com if you suspect any unauthorized use of your account.
You are liable for all activities conducted through your account.
You may not transfer, sell, or share your account with others.
We reserve the right to refuse registration or terminate accounts at our discretion.
3. User Content
You retain ownership of content you post, upload, or share ("User Content").
By posting User Content, you grant 3ybe a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform it in connection with operating, promoting, and improving the Service.
Example: If you share a photo, we may display it in feeds or use it in promotional materials.
You represent that you have the right to post User Content and that it does not infringe on third-party rights, including copyrights, trademarks, or privacy rights.
Prohibited content includes, but is not limited to:
- Pornography, sexually explicit material, or content depicting nudity.
- Content that incites, promotes, or glorifies violence, including threats or encouragement of harm.
- Illegal, defamatory, obscene, harassing, discriminatory, or harmful material.
- Content that violates any applicable laws or regulations.
Example: Posting adult videos or a message calling for violent protests violates these Terms.
We may monitor, review, edit, or remove User Content at our sole discretion without notice.
You are responsible for any legal consequences arising from your User Content.
4. Code of Conduct
You agree to use the Service in a manner consistent with its purpose of fostering authentic, respectful, and creative connections.
Do not engage in activities that:
- Violate laws, regulations, or third-party rights.
- Impersonate others or create false identities.
- Distribute spam, malware, or unauthorized advertisements.
- Attempt to gain unauthorized access to the Service or other users’ accounts.
- Interfood with the Service’s functionality, such as through hacking or overloading servers.
Example: Posting threatening messages or scraping user data violates these Terms.
We may suspend or terminate accounts for violations without prior notice.
5. Intellectual Property
The Service, including its design, software, logos, and content (excluding User Content), is owned by 3ybe or its licensors and protected by intellectual property laws.
You may not copy, modify, distribute, or reverse-engineer any part of the Service without written permission.

6. Privacy
Our Privacy Policy governs how we collect, use, store, and share your data.
You consent to the public display of User Content you mark as public.
You are responsible for managing your privacy settings to control visibility.
We are not liable for unauthorized access to your data due to your failure to secure your account.
7. Third-Party Content and Links
The Service may contain links to or content from third-party websites or services not controlled by 3ybe.
We are not responsible for the accuracy, legality, or availability of third-party content.
You access third-party links or services at your own risk.
Example: Clicking a link to an external blog does not imply 3ybe’s endorsement.
8. Termination
You may deactivate your account by contacting support@3ybe.com.
We may suspend or terminate your account or access to the Service at any time, with or without cause, including for violations of these Terms.
Upon termination, your license to use the Service ends, but our license to your User Content survives.
Deleted User Content may remain in our backups but will not be publicly accessible.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.
We do not guarantee the Service will be uninterrupted, secure, or error-free.
We are not responsible for User Content, third-party actions, or technical failures.
Example: If a server outage prevents access, we are not liable for any inconvenience.
10. Limitation of Liability
To the fullest extent permitted by law, 3ybe, its affiliates, officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim is limited to $100 or the amount you paid us in the prior 12 months, whichever is less.
This applies even if we were advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold harmless 3ybe and its affiliates from any claims, losses, or damages, including legal fees, arising from your use of the Service, your User Content, or your violation of these Terms or applicable laws.
Example: If your post leads to a lawsuit, you are responsible for related costs.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
Any disputes will be resolved exclusively in the state or federal courts located in Delaware.
You waive any objection to jurisdiction or venue in these courts.
You agree to attempt informal resolution by contacting us before filing any claim.
13. Changes to Terms
We may modify these Terms at any time by posting updates on the Service.
Continued use after changes constitutes acceptance of the updated Terms.

14. Force Majeure
We are not liable for failures to perform due to events beyond our control, such as natural disasters, wars, or government actions.
15. No Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and 3ybe regarding the Service.
If any provision is found unenforceable, the remaining provisions remain in effect.
